В середине января стало известно, что в декабре 2011 года в Нижнем Новгороде было предъявлено обвинение местным активистам движения "антифа" Артёму Быстрову, Павлу Кривоносову, Олегу Гембаруку, Альберту Гайнутдинову и Дмитрию Колесову. Все они обвиняются по ч. 2 ст. 282.1 УК (участие в экстремистском сообществе), ч. 2 ст. 213 (хулиганство, совершенное организованной группой лиц либо связанное с сопротивлением представителю власти), п. "б" ч. 2 ст. 115 и п. "б" ч. 2 ст. 116 (соответственно, умышленное причинение легкого вреда здоровью и побои по мотивам ненависти или вражды в отношении социальной группы), с учетом ч. 3. ст. 35 (совершение преступления организованной группой). Всем фигурантам дела вменяются в вину три эпизода столкновений с "представителями социальных групп скинхедов, футбольных фанатов".
В качестве доказательств по обвинению в организации экстремистского сообщества в деле указаны изъятые в ходе обыска периодические тиражные издания, SIM-карты, складной нож, компакт-диски, модем, компьютеры, пара штанов, нашивка с надписью "Antifaschistische Aktion", удостоверение некой организации "Antifa-R.A.S.H." и другие "материалы экстремистского содержания, запрещённые к гражданскому обороту".
По версии следствия, в январе 2007 года в Нижнем Новгороде было создано некое "экстремистское сообщество", представляющее собой "сплочённую, устойчивую, организованную группу лиц для подготовки и совершения преступлений экстремистской направленности". Цели группы: "пропаганда идей насильственного изменения государственного строя как проявления фашизма", "установление анархии" и "применение насилия по мотивам идеологической ненависти и вражды в отношении социальных групп "скинхеды, футбольные фанаты" и "состоятельные граждане России"".
Любопытным пунктом обвинения являются "мероприятия по уклонению от уголовной и административной ответственности": "ни в коем случае не давать показаний, не раскрывать данных соучастников, о задержании уведомлять адвоката".
Между тем, защита утверждает, что обвинение против Быстрова, Кривоносова, Гембарука, Гайнутдинова и Колесова сфабриковано инициатором дела – ЦПЭ (центром по противодействию экстремизму) ГУ МВД России по Нижегородской области – под руководством следователя подполковника юстиции Е.В.Блиновой.
Как указывают обвиняемые и адвокаты, потерпевшие "скинхеды, футбольные фанаты" не смогли сами опознать нападавших, есть также сведения, что их показания были получены под психологическим давлением со стороны сотрудников центра "Э". Кроме того, по версии защиты, удостоверения "Antifa-R.A.S.H." были подброшены обвиняемым (R.A.S.H., то есть Red & Anarchist Skinheads – распространенное во многих странах радикальное антифашистское движение). Адвокат Дмитрий Динзе заявляет, что двое обвиняемых, Быстров и Кривоносов, успешно прошли исследование на полиграфе.
Отмечаются многочисленные нарушения, допущенные полицией в ходе расследования дела, в том числе психологическое давление на фигурантов дела: угрозы уголовным преследованием и физической расправой в случае отказа от сотрудничества со следствием и подтверждения заготовленных заранее показаний. Так, адвокат Быстрова Антон Тарасов рассказал о том, что в кабинете следователя его подзащитному было предложено дать признательные показания, чтобы остаться на свободе под подпиской о невыезде, в противном случае следователи обещали добиться для него заключения под стражу. Впрочем, благодаря усилиям адвокатов во время предварительного следствия их подзащитные заключены под стражу не были.
Следователь Блинова отказалась удовлетворить ходатайство адвоката Дмитрия Динзе, в котором тот требовал, чтобы следствие предоставило дополнительные материалы, подтверждающие существование экстремистского сообщества "Antifa-R.A.S.H." и причастность к нему обвиняемых, а также назначения новой комплексной судебной экспертизы по делу.
Отметим также, что 19 января 2012 года после возложения цветов в рамках антифашистской акции памяти Станислава Маркелова и Анастасии Бабуровой в Нижнем Новгороде сотрудники ЦПЭ задержали двух активистов, один из которых, Александр Черный, проходит свидетелем по делу нижегородских антифашистов. Одного из задержанных отпустили, а Черный был доставлен на очередной допрос по делу, который длился около четырех часов и сопровождался побоями. Оба задержанных сообщили о происшедшем в полицию и зафиксировали телесные повреждения в бюро судебно-медицинской экспертизы.
Центр "СОВА" считает необходимым обратить внимание на два аспекта этого дела.
Во-первых, доказывание по ст. 282.1 должно вестись через установление фактов организованной деятельности, направленной на совершение преступлений экстремистской направленности, а не основываться на косвенных доказательствах типа антифашистских нашивок или "удостоверений" неформальной молодежной группы (даже если считать, что они делали такие странные удостоверения).
Во-вторых, мы снова повторяем, что законодательство, если уж оно не содержит конкретного перечня защищаемых социальных групп, не может защищать социальные группы, определенные, как удобно следствию. Достаточно ясно, например, что группа, которую следствие же определяет как "красных скинхедов", не могла руководствоваться ненавистью к "скинхедам" вообще. Следует отказаться от предъявления мотива ненависти к подобным социальным группам.
